Bernhard Samuelson
MP for Banbury Feb‑Apr 1859 and 1865‑1895
After sitting for a short period as member for Banbury in 1859, Samuelson was re-elected at the general election held in July 1865. His defeated opponent at that election, Charles Bell, subsequently petitioned against Samuelson's return, such petition being heard by a Select Committee of the House of Commons on 28 April 1866.
One of the provisions of the Act of Settlement of 1701 was that "no person born out of the Kingdoms of England, Scotland, or Ireland, or the dominions belonging (although he be naturalized or made a denizen, except such as are born of English parents) shall be capable to be of the Privy Council or a member of either House of Parliament, or to enjoy any office or place of trust, either civil or military, or to have any grant of lands, tenements or hereditaments from the Crown, to himself or to any other or others in trust for him."
It was later recognised that this provision needed to be relaxed in certain circumstances and as a result the British Nationality Act of 1772 was passed. This Act included the following words:-
Whereas divers natural-born Subjects of Great Britain, who profess and exercise the Protestant Religion through various lawful Causes, especially for the better carrying on of commerce, have been, or are, obliged to reside in several trading Cities and other Foreign Places, where they have contracted Marriages, and brought up Families: And whereas it is equally just and expedient that the Kingdom should not be deprived of such Subjects, nor lose the Benefit of the Wealth that they have acquired; and therefore that not only the Children of such natural-born Subjects, but their Children also, should continue under the Allegiance of His Majesty, and be intituled to come into this Kingdom, and to bring hither and realize, or otherwise employ, their Capital …
The following edited report of the hearing of Charles Bell's petition appeared in The Times of 30 April 1866:-
The Select Committee appointed to try the petition against the return of Mr. Bernhard Samuelson as member for Banbury met on Saturday. The petitioner was Mr. Charles Bell, an unsuccessful candidate for the representation of Banbury at the last election, and he prayed that the election of Mr. Samuelson might be declared null and void on the ground that he was an alien, and therefore incapacitated from occupying a seat in the House of Commons.
The case resolved itself into a long legal argument, occupying upwards of five hours, upon the question as to what constituted an alien. The petitioner prayed that the last election for Banbury should be declared void on the ground that Mr. Bernhard Samuelson was "wholly incapacitated and disqualified from sitting in the House of Commons by reason of his being an alien, and therefore not entitled to the rights and privileges of the natural born subjects of the Crown within the meaning of the statutes." A certificate of birth was put in from the registry of births in the German Israelite community of Hamburg, which set forth that, "in the year 1820, on the 22nd of November, at three of the clock in the morning, in this place, a male child was born to Samuel Hermann Samuelson, a native of Petersburg, in Virginia, and Sarah Hertz, his wife." That child, afterwards named Bernhard Samuelson, was the present sitting member for Banbury. A certificate of the marriage of the sitting member's father and mother was also put in, together with the return of the Banbury election, poll-books, etc.
Mr. Rodwell [counsel for the petitioner] then contended that the onus of proof rested upon the sitting member to show that he was entitled either by statute or by any other mode to sit in Parliament. Mr. Samuelson had stated in an address to his constituents that he had complied with the various Acts of Parliament passed for the naturalization of aliens, and he relied principally upon the 13th of George III., cap 21 [i.e. the British Nationality Act of 1772 quoted above], which naturalized the son or grandson of a British born subject, on condition that he took the sacrament in a Protestant place of worship, and that he also took the oath of allegiance. With both these conditions Mr. Samuelson said he had complied. It would be for him, however, to prove that those conditions were sufficient for the purpose of naturalizing an alien.
Mr. Phinn [counsel for Samuelson] urged, on the other hand, that no case had been made out, and asked for a nonsuit. Assuming that Mr. Samuelson and his father were both born abroad, that was not sufficient to constitute him an alien, as the law declared that the grandson of a natural born subject of the Crown inherited all the privileges of a natural born son himself. The onus of proof rested with the petitioner to show that Mr. Samuelson was not the grandson of a natural born subject, and as no proof had been tendered on that point, he contended that no case had been made out against his client.
Mr. Rodwell contended that it must be assumed that every man owed allegiance to the country in which he was born. It was proved that Mr. Samuelson was born at Hamburg, and that his father was born in Virginia, and in the absence of proof as to where the grandfather was born, the assumption was that they were both of them aliens. Under these circumstances, the proof as to where the grandfather was born rested on the sitting member.
Mr. Phinn said in that case it was to be assumed that Mr. Samuelson's father was a British subject, as, if he had been before the year 1784, the date of the treaty of Versailles, he must necessarily have been born a British subject.
After some discussion, the Committee decided that a sufficient case had been made out to call for a defence on the part of the sitting member.
Proof was then tendered by Mr. Phinn that Mr. Samuelson was the son of Mr. Samuel Hermann Samuels, or Samuelson, who was born in Petersburg, in Virginia, in the year 1789, married in 1815, and died in 1863. Mr. Samuel Hermann Samuels, it was also proved, was the son of Mr. Hyman Samuels, who was born in London, on the 4th of April, 1764, married at Hamburg on the 29th of August, 1787, and died in 1813. A family Bible with a record of dates was put in to prove these facts but [the petitioner's counsel] objected to its production on the ground that this was not a question of pedigree but a question of birth. There was no question as to who was Mr. Samuelson's grandfather; the question was where his grandfather was born.
[After considering the evidence] the Chairman said the Committee had unanimously resolved that Bernhard Samuelson, Esq., was not disqualified to be elected a member of Parliament by reason of his being an alien, and that he was duly elected a burgess to serve in the present Parliament for the borough of Banbury.
Alexander William Black
MP for Banffshire 1900‑1906
Black died as a result of injuries received in a train crash. The following edited account of the crash appeared in The Times of 31 December 1906:-
The lamentable railway accident which occurred on Friday [28 December 1906] at Elliot Junction, between Arbroath and Dundee, is the most disastrous in the history of Scotland. For some 24 hours before the accident the main line of the North British Railway from Edinburgh to Aberdeen had been blocked by great snowdrifts between Dundee and Arbroath. After great exertions, however, the line was so far cleared that on Friday morning a North British express which left Waverley Station, Edinburgh, at 7.35 got through as far as Arbroath. Further progress was found impossible; and it was decided to go back as far as Dundee or Edinburgh, some of the passengers from the latter city still being in the train. The return journey was begun between 3 and 4 o'clock in the afternoon. The engine pulling this train was one of the largest on the North British system, and, there being no turntable at Arbroath large enough to accommodate it, the engine had to be coupled to the carriage with the tender first. All went smoothly at the outset, and according to the driver, George Gourlay, the train did not travel particularly fast. "But," he adds, "before I had time to realize what had happened we dashed into a local train which was standing at the platform at Elliot Junction, and I was thrown down on my engine."
The North British express had, indeed, proceeded only about two miles on its southward ourney when it came into violent collision with a Caledonian local train which had been brought up owing to a goods train's being off the line, and at the moment of impact was awaiting a signal to proceed on its journey. A blinding snowstorm prevailed at the time, and hence the driver of the North British train was unable to see the Caledonian local train into the rear of which the express ran. The passengers in the express appear to have all escaped, or to have suffered but trifling hurts. Irvine, the fireman, was not so fortunate.
The full force of the collision fell with terrible effect upon the hapless occupants of the stationary local train. Soon the air was filled with the shrieks and groans of the injured and dying. Dead and injured were extricated with all expedition and laid side by side on the snow-covered ground, with the blizzard still raging around them. Nurse Duncan who was on the spot made splints from parts of the wreckage, and directing others to follow her example, she tore pieces from her skirt to make bandages. Gourlay, the driver, seems to have had a miraculous escape … He says the signals showed a clear line. According to his calculation his speed was not more than 20 miles an hour. Before Gourlay knew of the presence of any obstacle in is way he was almost upon the rear of the Caledonian Company's train and he had not, he says, time to draw up … Mr A. W. Black, M.P. For Banffshire, who was amongst the passengers in the Caledonian Company's train, sustained a compound fracture of both legs and nternal injuries and has since died.
Fourteen passengers were killed on the spot, and six of the injured have succumbed to their injuries, thus making the total number killed 20.
The oncoming of the express is described by eye-witnesses on the platform as astounding. The local train standing at the platform had few passengers to discharge. It is said that, hearing the noise of a train coming out of the storm, the guard had called to the passengers to change. At any rate, several passengers did leave the ill-fated train; and were walking up and down the platform trying to keep themselves warm until the driver got the signal to proceed. Out of the thickness of the storm and in the gathering gloom dashed the second train, ramming the standing train in the rear. The guard's van and the last coach were shattered to atoms, and the second coach from the rear was completely telescoped. The carriage nearest the engine did not suffer so much, and the locomotive itself kept the metals notwithstanding the impact.
William Compton Carr
MP for Baron's Court 1959‑1964
In December 1971, Carr was imprisoned for fraudulent conversion and theft, as reported in The Guardian on 22 December 1971:-
William Compton Carr (53), Conservative MP for Barons Court from 1959 to 1964, was sentenced to 18 months imprisonment at the Old Bailey yesterday after pleading guilty to fraudulent conversion and theft of clients' money totalling £19, 659 while a solicitor.
Judge Bernard Gillis, QC, told Mr. Carr: "The gravity of the offence is continued dishonesty over a period of more than two years." Mr. Carr, of Exeter Road, Cricklewood, North London, had pleaded guilty to six charges and had asked for seven similar offences to be considered.
Mr. John Mathew said that in 1966-9 Carr was practising as a solicitor in a firm called Carr and Company. After RAF service he was admitted as a solicitor in 1950 and he practised until 1959, when political matters took his time until 1964.
After losing his seat in the 1964 general election, he set up on his own as a solicitor the following year, practising at Jermyn Street.
In a police statement he said he had to borrow heavily to buy out his partner in order to set up on his own. As a result he was always in financial difficulties.
Mr. Mathew said Mr. Carr then began his offences of fraudulent conversion and theft of clients' money, the total amount involved being £19,659. Detective Chief Inspector Alan Wheeler said Mr. Carr was married, but separated, and he had three grown-up children.
He had served with an excellent character in the RAF, and he was now earning £1,200 a year as a clerk, living in a furnished room on his own. Mr. Kenneth Jones, QC, defending said that it was very difficult to ascertain where the money had gone.
"The position is that in no instance did he obtain that money dishonestly from anybody, but, having obtained it honestly, he frankly admits with great shame that he fraudulently converted it." Mr. Jones called several public figures to give evidence on Mr. Carr's behalf.
They included Mr. William Fergus Montgomery, Conservative MP for Brierley Hill, and Lord Royle, Labour MP for West Salford from 1945 to 1964.
Mr. Jones, in mitigation, said Mr. Carr had got into desperate financial straits while he was an MP. He had no means other than his MP's salary and did a great deal of entertaining. This ran him heavily into debt, and he borrowed from his own bank, from friends, and even from a money lender. He went into deep trouble when he lost his seat and wanted to go back into business as a solicitor.
He was faced with an ultimatum from one of his partners that he should pay £20,000 of that partner's share, or the partnership would be dissolved.
In the middle of 1966 his practice had virtually gone and he accumulated debts of about £50,000. It was from that time onwards that he started taking the money from his clients' accounts.
William Beckett-Denison
MP for East Retford 1876‑1880 and Bassetlaw 1885‑1890
Beckett was the third son of Sir Edmund Beckett, 4th baronet, and younger brother of the 1st Baron Grimthorpe. He sat in the House of Commons for East Retford between 1876 and 1880 and for Bassetlaw between 1885 and the time of his death.
The following account of Beckett's death is taken from The Manchester Times of 28 November 1890:-
Mr W. Beckett, M.P. for the Bassetlaw Division of Nottinghamshire, met with a sad death at Wimborne on Sunday [23 November 1890], being knocked down and cut to pieces by a train. Mr Beckett arrived at Wimborne by a train which goes on to Weymouth, and alighted from a first-class carriage. He then asked a porter named Richard Harvey when there was a train for Bournemouth. Harvey replied that there was one immediately, and another at four o'clock. Mr Beckett said, "the four o'clock one will do for me." and left the station to cross the line by the subway. He then walked away, and Harvey, who had to take some luggage to the bank in the town of Wimborne, saw him in the square there. This was half an hour after he had left the station. Later he was seen in the Canford Drive, which passes under the railway, and the next seen of him was on the railway bridge crossing the river Stour. Levi Amans, the signalman, says that he had signalled in the 3.30 p.m. train from Bournemouth, and after it had passed his box he looked after it, and saw deceased walking on the up side of the line that the train was on. The wind was blowing very hard, and as the train came up to the deceased his hat blew off, and almost immediately deceased fell under the train. He was struck by the second or third carriage, and the body was rolled along under the wheels and was carried along the bridge for 56 feet, rolling out from under the last carriage. The deceased had on a dress coat with a waterproof over it. Police-sergeant Burden had the mangled remains placed on a stretcher and conveyed to the inn.
In May and June of 1900, Beckett's executors were sued by a Mrs Gertrude Beatrice Brinkworth, in order to recover a sum of £1,136 which she alleged was owing to her. Her story was that, in 1882, aged 17 and having just left school, she became the mistress of the late William Beckett. She was represented by Beckett to be a Mrs Wheatley, his adopted daughter. She further alleged that, in order to protect her future welfare, Beckett had, in 1889, purchased a house for her in Bournemouth, and that his reason for being near Bournemouth on the day of his death was that he was visiting her.
Mrs Brinkworth further alleged that Beckett was extremely anxious that she should have children. As a result, three children were advertised for and adopted, and passed off as her own. An allowance of £200 per child was paid for two years after Beckett's death, but payments then ceased, since the executors had discovered that the children were not fathered by Beckett. Before the evidence in the case had been completed, the jury stepped in, declaring the whole of Mrs Brinkworth's case to be a 'swindle' and rejected her claims.
