Sir Bryan O'Loghlen, 3rd baronet
MP for Clare 1877‑1879
O'Loghlen was educated at Oscott College, Birmingham, and Trinity College, Dublin. He graduated B.A. in 1856, and in the same year was called to the Irish Bar. He practised law in Ireland for five years before deciding to emigrate to Melbourne, Victoria, where he arrived in January 1862.
In 1863, O'Loghlen was appointed Crown Prosecutor for Victoria, a position he held until 1877 when he unsuccessfully contested a seat in the Victorian Legislative Assembly. In the same year, his older brother Sir Colman Michael O'Loghlen, 2nd baronet, died and O'Loghlen succeeded him as the third baronet. His older brother had represented County Clare in the House of Commons, and on his death, Sir Bryan O'Loghlen was returned in his place. From the newspapers of the time, it appears that Sir Bryan did not play any active role in the by-election in which he was returned - his name was put forward by the Roman Catholic clergy of County Clare. He was certainly not present in the constituency at the time of the election, nor did he return from Victoria to take his seat in the House of Commons.
In 1878, Sir Bryan was successful in an election for the Victorian Legislative Assembly and was immediately appointed Attorney-General in the administration of Graham Berry. His acceptance of this appointment gave rise to the question of whether he had accepted an office of profit under the Crown, which would automatically disqualify him as a member of the Commons. More broadly, the question was whether the definition of "office of profit" extended to Colonial appointments.
In order to answer this question, the House appointed a Select Committee to look into the matter. The Committee's initial report in August 1878 stated that it was only fair that Sir Bryan be given the opportunity to defend his position, and the matter was carried over to the next session. The matter was finally decided on 25 April 1879. The following report of the proceedings appeared in the Sheffield and Rotherham Independent on 26 April 1879:-
On the consideration of the report from the Select Committee on Clare County Writ, Mr. Cross [the Home Secretary] said the committee appointed to inquire into the question of whether Sir Bryan O'Loghlen was precluded from taking his seat in the House owing to his having accepted the post of Attorney-General for the Colony of Victoria, had fully considered the matter, and they were of opinion he was disqualified by the statutes, as the appointment he had accepted was an office or place of profit. He moved that the seat be declared vacant.
Sir Julian Goldsmid moved an amendment to the effect that it was undesirable to decide by resolution a doubtful question of grave importance involving the status of members of the House, and showing it was expedient that a bill should be brought in to settle the law relating to the disqualifications caused by accepting Colonial offices. He contended that as the Victoria Colony was established as a self-governing constitutional Colony the House had nothing to do in the election of Sir Bryan O'Loghlen, who really was non-official as concerned this country, the House having nothing to do with his appointment or his acceptance of it.
Sir Henry James said if the statute existed on the statute books, and controlled the Colonial constitution, they had to carry it into effect, but the whole question was whether the office was a new office, and was under the Crown. Now, the Governor of Victoria was appointed by the Crown, and was invested with powers by which he had appointed Sir Bryan O'Loghlen. Therefore there could be no doubt that the appointment was a Crown appointment.
When the House voted on the matter, members voted overwhelmingly in favour of the Home Secretary's motion that the seat be declared vacant, with the result that a new writ was issued for the constituency.
Sir Bryan remained in Victoria for the rest of his life, becoming Premier of Victoria between July 1881 and March 1883.
Richard Fort
MP for Clitheroe 1950‑1959
Fort died in a car accident in May 1959. The following report of the subsequent inquest into his death appeared in The Times on 19 June 1959:-
Mr. Richard Fort, aged 51, Conservative M.P. for Clitheroe, lost control of his car before the rash in which he died, Mr. H.L. Franklin, the coroner, said yesterday at the resumed inquest at Littlemoor, Oxfordshire. The jury returned a verdict of Accidental Death on Mr. Fort, whose car was involved in a collision with a coach on the Oxford-Henley road between Sandford and Nuneham Courtnay on May 16.
Edward George Cook, of Stewart Avenue, Hendon, Middlesex, a passenger in the coach, said: "I saw a small Austin approaching round a slight curve. The driver seemed to be bent over the wheel. He left the white line and came straight towards the coach." Another passenger, Arthur Leonard Enstone, of Mayfield Crescent, Hendon, said the driver of the car "was as white as a sheet and just staring at us."
Dr. Walter Richards, assistant pathologist at Radcliffe University, Oxford, said Mr. Fort's heart was slightly abnormal, but not sufficiently to indicate a heart attack before the accident. He was suffering from a gallstone, which might have caused him pain.
Returning the verdict, the jury foreman said that the medical evidence had not given them a clue as to the state of the car driver.
John Jagger
MP for Manchester Clayton 1935‑1942
Jagger was killed in a road accident in July 1942. The following report appeared in The Times of 10 July 1942:-
Mr. John Jagger, Labour M.P. for the Clayton Division of Manchester since 1935, and Parliamentary Private Secretary to Mr. Herbert Morrison, the Home Secretary, was killed in a road accident at Beaconsfield, Bucks, yesterday.
Mr. Jagger had been staying at a cottage at Beaconsfield, and was on his way to Beaconsfield station to catch a train to London when the autocycle he was riding came into collision with a motor-car. He was killed instantly.
When Mr. Herbert Morrison was Minister for Supply Mr. Jagger was his Parliamentary Private Secretary, and when Mr. Morrison became Home Secretary Mr. Jagger served in a similar post. For many years Mr. Jagger was general president of the National Union of Distributive and Allied Workers. He had travelled four years in India, Burma, and China as a business manager before taking up full-time trade union work. Before the present war he was a member of the tribunal which met in Trinidad to consider wage increases for oil workers there. Formerly he was president of the Amalgamated Union of Co-operative Employees, of which union he was the chief founder. In 1938, during the Spanish civil war, Mr. Jagger was one of the Labour M.P.s who visited Spain.
