processing note 1: (616/59): Hon Anthony Wedgewood Benn succeeds to peerage as 2nd Viscount Stansgate. He signed an instrument of renunciation and petitioned the House of Commons to set up a Select Committee to examine his case. The House referred the matter to the Committee of Privileges who confirmed that he was disqualified from sitting in the House of Commons. A new writ was issued, and Viscount Stansgate decided to contest the by-election to draw attention to what he considered to be an unjust law.
processing note 2: (1820/59): The Court held that Viscount Stansgate was disqualified from sitting in the House of Commons and declared Malcolm St Clair duly elected. Malcolm St Clair then gave an undertaking to resign the seat if a subsequent change in the law permitted Viscount Stansgate to be elected to the House of Commons.
