| (SENATORS OF THE COLLEGE OF JUSTICE IN SCOTLAND) | ||||||
| The Court of Session, founded in 1532, is the supreme civil | ||||||
| court of Scotland. The Court was divided into two houses in | ||||||
| 1810 - the Inner House and the Outer House, The Inner House | ||||||
| acts as a Court of Appeal, while the Outer House acts as a | ||||||
| Court of First Instance, and may also have appeals referred to | ||||||
| it by the Inner House. | ||||||
| The Inner House is, in turn, divided into two divisions - the | ||||||
| First Division, headed by the Lord President of the Court of | ||||||
| Session, and the Second Division, headed by the Lord Justice | ||||||
| Clerk. Senators have often been promoted from the Outer | ||||||
| House into the Inner House. | ||||||
| On appointment to the College of Justice, a Senator takes a | ||||||
| judicial title, which is retained for life. Although styled 'Lord/ | ||||||
| Lady', Senators of the College of Justice are not peers, | ||||||
| although some Senators have been created peers either | ||||||
| before, during or after their terms in office. | ||||||
| Until 1721, a substantial number of Extraordinary Lords of | ||||||
| Session were appointed. Sorting out whether some of the | ||||||
| early Lords of Session were appointed as Ordinary or | ||||||
| Extraordinary Lords has been extremely difficult, but I have | ||||||
| relied on such authorities as I could obtain. | ||||||

| Sir George Lockhart, Lord Carnwath | ||||||
| Lockhart was murdered in March 1689 by John Chiesley, father of Lady Grange, who is the subject | ||||||
| of a separate note under "Lord Grange" [see below]. Chiesley had been unhappily married to Margaret | ||||||
| Nicholson, who sued him for alimony. Lockhart granted her application, which so infuriated Chiesley | ||||||
| that he shot and killed Lockhart as he walked home from church on Easter Sunday, 31 March 1689. | ||||||
| The following account of his trial is taken from "A Collection and Abridgement of Celebrated Criminal Trials | ||||||
| in Scotland" by Hugo Arnot [Edinburgh 1785]:- | ||||||
| 'The prisoner was brought before the Lord Provost on the 1st of April 1689, to be examined concerning | ||||||
| the murder of Sir George Lockhart, committed on the day preceding. Sir John Lockhart of Castlehill, | ||||||
| brother, and Cromwell Lockhart of Lee, nephew of the deceased, appeared in Court, and, in their own | ||||||
| name, and in that of the children of the deceased, gave in an act of the meeting of Estates of | ||||||
| Parliament, passed that very day, of the following purport: That the Estates having considered the | ||||||
| supplication of the friends of the deceased Sir George Lockhart, for granting warrant to the magistrates | ||||||
| of Edinburgh to torture John Chiesley of Dalry, perpetrator of the murder, and William Calderwood writer | ||||||
| in Edinburgh, an accomplice; therefore, in respect of the notoriety of the murder, and of the extraordinary | ||||||
| circumstances attending it, the Estates appoint and authorise the Provost and two of thye bailies of | ||||||
| Edinburgh, and likewise the Earl of Errol, Lord High Constable, and his deputes, not only to judge of the | ||||||
| murder, but to proceed to torture Chiesley, to discover if he had any accomplices in the crime.....The | ||||||
| Estates, at the same time, declare, that this extraordinary case shall be no precedent to warrant torture | ||||||
| in time coming, nor argument to ratify it as to the time past. | ||||||
| 'The prisoner was then put to the torture, and declared that he was not advised to the assassination | ||||||
| of Sir George Lockhart by any person whatever: That, when at London, he told James Stewart advocate, | ||||||
| that, if he got no satisfaction from the President [i.e. Lockhart], he would assassinate him; and told the | ||||||
| same to a person there of the name of Callender, and to Mr. William Chiesley his uncle. He confessed | ||||||
| that he charged his pistol on Sunday morning, and went to the New Kirk, and having seen the President | ||||||
| coming from the church, he went to the close where the President lodged, followed him, and when just | ||||||
| behind his back, shot him; That he was satisfied when he heard of the President's being dead; and, on | ||||||
| hearing it, he said, "he was not used to do things by halfs." He also confessed, that, when at London, | ||||||
| he had walked up and down Pall-Mall with a Pistol beneath his coat, lying in wait for the President. | ||||||
| 'The indictment against the prisoner was raised at the instance of John Gibson, procurator-fiscal of the | ||||||
| city of Edinburgh, of Sir John Lockhart of Castlehill, and Cromwell Lockhart of Lee. It set forth, that | ||||||
| assassination, murder, and man-slaughter, were contrary to the laws of God, Nature, nations, and the | ||||||
| laws and acts of Parliament of this kingdom: That, nevertheless, the prisoner had, of forethought felony, | ||||||
| without the least provocation, murdered Sir George Lockhart in the manner already mentioned: That the | ||||||
| prisoner was caught red-hand by a multitude of witnesses, before whom he boasted of what he had done, | ||||||
| as if it had been some grand exploit: By all which he was guilty of murder, or at least was art and part | ||||||
| accessory to the same; for which he ought to be punished with death, and his moveables confiscated. | ||||||
| 'The prisoner judicially confessed the crime libelled, and declared, that he committed the murder because | ||||||
| he thought the deceased had given an unjust sentence against him. Being asked "if it was not a sentence | ||||||
| pronounced in favour of his wife and children for their aliment he declared he would not answer to that | ||||||
| point, nor give any account thereof." | ||||||
| [After a number of witnesses had given their testimony] 'The jury all in one voice....found, by the | ||||||
| prisoner's judicial confession, that he was guilty of the murder of Sir George Lockhart, and by the | ||||||
| deposition of witnesses, that he was guilty of "murder, out of forethought felony." | ||||||
| 'The Lord Provost and Bailies of Edinburgh sentenced the prisoner to be carried on a hurdle from the | ||||||
| tolbooth of Edinburgh, to the market cross, on Wednesday the 3rd of April instant; and there, between | ||||||
| the hours of two and four of the afternoon, to have his right hand cut off alive, and then to be hanged | ||||||
| upon a gibbet, with the pistol about his neck, with which he committed the murder. His body to be hung in | ||||||
| chains between Leith and Edinburgh; his right hand fixed on the West-port, and his moveable goods to be | ||||||
| confiscated.' | ||||||
| George Patton, Lord Glenalmond | ||||||
| Patton disappeared on 20 September 1869. The first intimation in the Press appears to have been | ||||||
| on 22 September when the papers reported the disappearance. The 'Western Mail' (Cardiff) stated | ||||||
| that 'great excitement has been caused in Edinburgh by the disappearance of Mr. George Patton, | ||||||
| Lord Justice Clerk. He went out for a walk before breakfast on Monday morning and has not been | ||||||
| heard of since. His name was prominently brought forward through evidence at Bridgwater.' | ||||||
| The reference to Bridgwater relates to the unseating of the sitting members in February 1869 | ||||||
| for bribery and corruption - the seat was subsequently disenfranchised in 1870. See also the final | ||||||
| paragraph. | ||||||
| Patton's body was found on 24 September, as reported in the 'Glasgow Herald' of 25 September 1869:- | ||||||
| 'The mystery surrounding the disappearance of the Lord Justice Clerk has now been solved, his body | ||||||
| having been found yesterday afternoon in the River Almond. Since his Lordship's disappearance on | ||||||
| Monday the general opinion was that he had fallen into the river accidentally and had been drowned; | ||||||
| but the finding of a razor-case and necktie…..gave rise to the belief that his Lordship had committed | ||||||
| suicide. On Monday and Tuesday the woods and moors in the district were searched by hundreds of | ||||||
| willing persons, and the river was carefully dragged from the fall downwards. The finding of the razor- | ||||||
| case and necktie by the edge of the river pointed so directly to the probability of the body being in | ||||||
| the water that on Wednesday, Thursday and yesterday the search was confined solely to the river. | ||||||
| On Wednesday the authorities secured the services of an experienced boatman……and he at once | ||||||
| initiated a thorough search of the river. It being supposed that the body was lying in a deep pool near | ||||||
| the fall, the attention of Malloch [the boatman] and his assistants was almost entirely confined to | ||||||
| that part of the stream for two days, but the result was not satisfactory. Yesterday, shortly before | ||||||
| noon, Malloch commenced operations with a new set of creepers…..He made a thorough search of | ||||||
| the pool already mentioned, but without effect. He then commenced to drag the river farther down, | ||||||
| and the result was that at a quarter-past three o'clock the body of the Lord Justice Clerk was found….. | ||||||
| The appearance of the body was most revolting, there being a deep gash in the throat, bearing out | ||||||
| the theory that before falling into the water his Lordship had endeavoured to end his existence by | ||||||
| cutting his throat……' | ||||||
| As to motive, The 'Pall Mall Gazette' commented that 'it is impossible to avoid thinking of the manner | ||||||
| in which the late Lord Justice Clerk Patton's name has lately been mentioned at Bridgewater [sic] in | ||||||
| connection with the sad tragedy at Glenalmond. No one can be blind to the possible effect on a | ||||||
| delicate-minded and sensitive Judge of an impending examination as to bygone electoral expenditure, | ||||||
| incurred perhaps at the time without sufficient consideration, or under some sort of compulsion, which | ||||||
| might fix him with moral responsibility for corrupting and bribing, and thus bring doubt or discredit oh his | ||||||
| judicial office.' | ||||||
| In February 1870, the report of the Bridgwater Election Commissioners stated that, during the period | ||||||
| 1831 to 1869, every election which had taken place (11 general elections and 3 by-elections) had | ||||||
| been corrupt. In particular, the report found that 'in respect of the by-election of 7 June, 1866, that | ||||||
| Walter Bagehot, and George Patton, Esquires, the candidates, were privy and assenting to some of | ||||||
| the corrupt practices extensively prevailing thereat.' | ||||||
| James Erskine, Lord Grange | ||||||
| Erskine was the son of the 5th Earl of Mar [of the 1565 creation] and younger brother of the 6th Earl. | ||||||
| As a result of his adherence to the Jacobite cause, his brother was attainted in 1716 and his peerage | ||||||
| forfeited. | ||||||
| James is best remembered for his treatment of his wife. He married Rachel Chiesly, having first 'debauched' | ||||||
| her before being compelled to marry her. Like the rest of her family, she is described as being proud, | ||||||
| violent and jealous, a drunkard and, at times, an imbecile. Her husband was constantly absent from | ||||||
| her due to his duties as a judge; she suspected him, probably with good reason, of being unfaithful to | ||||||
| her and, as a result, hired men to spy upon him. Her conduct was an open scandal, causing Grange to | ||||||
| be much pitied by his friends, who defended Grange by charging that his wife had wrongly accused him | ||||||
| of treason, had stolen his letters to support this groundless accusation and had made attempts upon | ||||||
| his life. | ||||||
| His sister-in-law, the Countess of Mar, who was the sister of Lady Mary Wortley Montagu, the writer | ||||||
| and pioneer of innoculation against smallpox, was also at times judged to be insane. In April 1731, Grange | ||||||
| attempted to carry off the Countess from England to Scotland, but was thwarted by her sister. These | ||||||
| scandals had a major effect upon Grange's health, but in 1732 this improved when he publicly celebrated | ||||||
| his wife's funeral. The major difficulty with this celebration was that his wife was still alive and held as | ||||||
| a prisoner, a fact unknown to any of her friends. | ||||||
| Lady Grange lodged with a Mrs Maclean in Edinburgh. On the night of 22 January 1732, Mrs Maclean | ||||||
| allowed a number of highlanders dressed in the Lovat tartan to enter the house, where they seized | ||||||
| Lady Grange and carried her off to Linlithgow. She was then taken to Falkirk and then Pomeise, where | ||||||
| she was concealed in a closet for three months before being moved, travelling only at night and not | ||||||
| sleeping in a bed for weeks, to the west coast where she was placed in a sloop and taken to the island | ||||||
| of Hesker, where she remained for five years. At the end of this period, she was taken to the lonely | ||||||
| island of St. Kilda, the westernmost island of the Outer Hebrides, 40 miles from the nearest land, where | ||||||
| she was kept for another seven years. Finally, she was taken to Skye, where she died in May 1745. | ||||||
| Her release from St. Kilda was made possible only after the visit to the island of a minister and his wife | ||||||
| to whom she told her story. Eventually she was able to convey her situation to friends on the mainland | ||||||
| who despatched a brig to her assistance. | ||||||
| When her strange history became known, Lord Grange argued that his wife was mad, and that there was | ||||||
| no asylum fit for such patients in Scotland; what better could he have done than to provide her with a | ||||||
| retreat where she was at once secure from escape and safe from injury? On the other hand, it seems | ||||||
| far more likely that Lady Grange was confined because she was privy to too many secrets relating to | ||||||
| the Jacobite cause and her madness caused the Jacobites constant fears that she might betray them. | ||||||
| James Burnett, Lord Monboddo | ||||||
| The following is extracted from "The Emperor of the United States of America and Other | ||||||
| Magnificent British Eccentrics" by Catherine Caufield (Routledge & Kegan Paul, London 1981) | ||||||
| Lord Monboddo was a man of individual opinions, maintaining, among other things, that | ||||||
| orang-outangs are a human species, capable of speech. He also believed that babies are | ||||||
| born with tails but that there is a conspiracy of silence among midwives, who cut them | ||||||
| off at birth. Monboddo was a careful observer at the births of his own children, but in each | ||||||
| case the midwife outwitted him and managed to destroy the evidence. | ||||||
| According to the biographer Robert Chambers [in "Biographical Dictionary of Eminent Scotsmen'] | ||||||
| Monboddo was 'by far the most learned judge….of his time.' Monboddo would not have found | ||||||
| this a flattering comment, as he heartily despised 'his time': he had a passion for the ancients, | ||||||
| their way of life and language. Though he was a just and compassionate landlord, Monboddo | ||||||
| approved of slavery on the grounds that Plutarch had defended it. He also attempted to revive | ||||||
| the religious beliefs of ancient Greece. Hearing of Dr. Johnson's Dictionary, Monboddo expressed | ||||||
| shock that a man of Johnson's ability could waste his time on English when Greek was clearly | ||||||
| the only language worth preserving. | ||||||
| He lived quite simply, partly as a result of refusing to use any tool or convenience not enjoyed | ||||||
| by the Greeks. In 1785, on one of his rare visits to London he was invited to observe a trial | ||||||
| in progress at the Court of the King's Bench. The proceedings were interrupted when someone | ||||||
| ran into the courtroom shouting that the roof was falling in. Panic ensued as lawyers, judges | ||||||
| and witnesses all ran to the door and tried to force their way out. Monboddo, who was deaf | ||||||
| and short-sighted, sat through the entire episode quite calmly, making no attempt to join the | ||||||
| fleeing masses. Finally, it was realised that the warning had been a false alarm and everyone | ||||||
| returned to their seats. Asked how he had managed to remain so calm in the face of threatened | ||||||
| disaster. Monboddo replied that he had supposed that he was watching an annual ceremony with | ||||||
| which, as an alien to the English laws, he had no concern, but which he considered interesting | ||||||
| to witness as a remnant of antiquity. | ||||||

| This extract provides only a view of Monboddo's eccentricities. In reality, Monboddo was a | ||||||
| pioneer in the sciences of historical linguistics and Darwinian evolution, having outlined the basic | ||||||
| principles of natural selection well in advance of Darwin. | ||||||
